By accessing and using AiKissVideo ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Age Requirement

You must be at least 18 years old to use this Service. By using AiKissVideo, you represent and warrant that you are 18 years of age or older.

3. Permitted Use

You agree to use AiKissVideo only for lawful purposes. You may ONLY upload:

• Photos you personally own the rights to
• Photos of yourself and/or consenting adults who have given you explicit permission
• Photos of adults only (no minors under any circumstances)

4. Prohibited Uses

You MAY NOT use AiKissVideo to:

• Create deepfakes of public figures, celebrities, or politicians without consent
• Upload photos of minors (anyone under 18)
• Upload photos of people without their consent
• Create content that is pornographic, harassing, or defamatory
• Violate any local, state, national, or international law
• Impersonate any person or entity
• Distribute generated content in a misleading or deceptive manner

5. AI-Generated Content Disclosure

All videos generated by AiKissVideo are AI-generated synthetic media. You agree that:

• Free videos will contain a visible watermark identifying them as AI-generated
• You will not claim AI-generated content as real footage
• You will disclose that content is AI-generated when sharing publicly

6. Content Ownership & License

You retain all rights to photos you upload. By uploading photos, you grant AiKissVideo a limited license to process them for video generation purposes only. Generated videos are provided for your personal use.

7. Data Retention

Uploaded photos and generated videos are automatically deleted from our servers after 30 days. We do not use your content for AI training or share it with third parties.

8. Payment & Refunds

Payment is processed through Creem. Due to computational costs, refunds are not provided once video generation begins. We recommend trying the free version first.

9. Service Availability

We do not guarantee uninterrupted access to the Service. Video generation may fail due to technical issues, and we reserve the right to refuse service or terminate accounts that violate these terms.

10. Limitation of Liability

AiKissVideo is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the Service, including misuse of generated content by you or third parties.

11. Indemnification

You agree to indemnify and hold harmless AiKissVideo from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Service.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in accordance with applicable law.
